Sickness benefits with claims for damages against third parties

In the event of inability to work, employees continue to be paid by the employer, receiving sick pay for a minimum period of six weeks.

If the inability to work has been caused by a third party (eg. traffic accident, criminal act), the employee has a duty to notify the Personnel Department immediately and to transfer his title to claims for damages in the amount of the remuneration, including additional expenses, to which the employer is obliged.

The place of work has the right to withhold sickness benefits until such time as the claims have been transferred (Right of Retention law as per § 273 BGB).

Should the employee not comply with his duty to cooperate in the transfer of a claim, the place of work can claim compensation from him for the amount stated above.

Civil servants who are unfit to work may claim the continued payment of official emoluments.

If the unfitness for work has been caused by a third party, the civil servant has a duty to notify the Personnel Department immediately. The civil servant's claim for compensation against the initiator is transferred to the employer insofar as the latter is obliged to continue to pay emoluments during the period of unfitness for work (§ 94 ThürBG, legal transfer of claims).
